FGS DASHBOARD FOR POWER BI TERMS OF USE

Important: Read Carefully

These terms of use govern your use of the Mortgage Management Dashboard (“dashboard”) created by Fraga Graphic Solutions, LLC (“FGS”). FGS may change the terms of use for this dashboard and will provide notice of such change by updating the terms of use published at https://fragagraphics.com/power-bi-terms. You are responsible to review these terms of use periodically and to remain compliant with any such changes. If you do not consent to these terms of use of dashboard, please cease use immediately.

FGS grants to you a personal, revocable, nonexclusive, nontransferable right to use dashboard for your business use solely in conjunction with your authorized use of Power BI. You may view, use, copy, publicly display or redistribute visuals and tables derived from dashboard in hard copy or static, electronic formats (e.g., PDF, GIF, JPEG) if you retain the attributions listed at the bottom of dashboard.

You may not (i) use dashboard as a service bureau; (ii) reverse engineer, decompile, or disassemble dashboard; (iii) manually or systematically collect or scrape data from dashboard; (iv) benchmark the availability, performance, or functionality of dashboard for competitive purposes; (v) probe, scan, or test the vulnerability of dashboard or breach any security or authentication measures used by dashboard.

Requests for additional user access should be submitted to FGS in writing before access will be provided. Access being granted to dashboard is at the discretion of FGS and may be revoked at any time, for any reason. In the event that a user’s access should be revoked, you assume responsibility of notifying FGS in writing of termination of access. FGS will not be held liable for lack of communication or miscommunication regarding permitted access to dashboard.

You do not receive title to or ownership of dashboard, user documentation, FGS data, or FGS trademarks hereunder. FGS reserves all rights not expressly granted herein. You hereby grant FGS and its service providers nonexclusive, nontransferable, worldwide right to host, run, and reproduce your data solely for the purpose of enabling your use of dashboard. Without your permission, FGS will not access, use, or disclose your data except to comply with the law or any court or government order. You retain all right, title, and interest in your data. Dashboard is provided “AS IS” without any warranty of any kind. Dashboard is not designed, manufactured, or intended to use in environments or applications that may lead to death, personal injury, or physical property/environmental damage. FGS is not responsible for any damages, liabilities, or losses that may result from any (i) use of or (ii) interruption or suspension of dashboard.

In addition to the terms of use here, which are specific to dashboard, you agree to follow the Power BI Software Terms of Service and User Agreements. If you are in violation of these agreements and access to Power BI Software is revoked, this will terminate access to dashboard.

The failure of FGS to enforce any provision of these terms of use will not be deemed a waiver of the provisions or the right of FGS thereafter to enforce that or any other provision. You agree that if any provision of these terms of use is held to be unenforceable for any reason, such provision will be reformed only to the extent necessary to make the intent of the language enforceable. You will not assign, sublicense, or transfer any rights or obligations under these terms of use and any attempts to do so without consent will be void. US federal law and the law of the State of Ohio govern these terms of use, excluding their respective choice of law principles. These terms of use are not subject to the United Nations Convention or Contracts for the International Sale of Goods.
